Methodical biotechnology guidelines on cadastral registration of restrictions and encumbrances of land plots

Restrictions (encumbrances) are the existence of conditions and prohibitions that limit the right holder in exercising the
right of ownership or other property rights to a specific real estate object (servitude, mortgage, trust management, lease,
seizure of property, etc.), established by the law or the authorized bodies in accordance with the law (Article 1 of the
Federal Law dated July 21, 1997 No. 122-FZ "On State Registration of Rights to Real Estate and Transactions Therewith").
Currently in Russia, there is a pressing need to take into account restrictions and encumbrances in the composition of land
plots, such as: lands with a special regime of use, common-use lands, transactions, seizures, prohibitions, real estate
objects, servitude, etc., in order to comply with the established legal regime. A serious problem is the issue of the passage
of restrictions (encumbrances) of state-registered land plots, which results in assigning cadastral numbers to parts of land
plots, formed in connection with the imposition of restrictions (encumbrances) on land plots. A land plot is identified by its
cadastral number, including its restrictions (encumbrances), in the Unified State Register of Real Estate Rights and
Transactions Therewith. The work is also relevant due to the "land reform" that began on March 1, 2015, which directly
affects servitudes, established for land plots in state or municipal ownership.
